A copy of said International Fire Code, 2012 Edition, and all appendices, shall be filed with the City Clerk for inspection by the public prior to such meeting.
This Amended Legal Notice is being published to correct the date of final passage previously noticed. The remaining content of said Legal Notice, published September 12, 20104 and September 19, 2014, shall remain in effect, to include the right of the public to make objection to the final adoption of Ordinance 1278 at the date, time and place noticed herein.

If forwarded by mail, the Bid and sealed envelope marked as described above must be enclosed in another envelope with the notification "SEALED BID ENCLOSED" on the face of the outer envelope and addressed as indicated above.  
The site is east of Hardin, Montana and can be accessed by travelling east from Hardin on Highway 384, 33.2 miles to the intersection with Horse Creek Road (gravel) and then travelling east 3.17 miles to an intersection with a private unimproved road and then travelling north and then east 5 miles on the private road to the project site . The location of the site and access road is shown on Sheet 1 of the Project Drawings.
Bids will be received for one General Contract.  The work will include mobilization and demobilization; improvement and maintenance of site access; provide water; excavation and removal of soil overburden and burning coal; haulage and burial of excavated burning coal material in an on-site disposal pit; fence; grade, contour, revegetation of disturbed areas; and provide BMPs for sediment control.
The project will include all incidental work necessary to complete the project as specified in the Contract Documents.
In order that prospective bidders’ names appear on DEQ’s plan holder’s list, that potential bidders’ Contract Documents are uniform, accurate, and have not been modified in any way, and so that potential bidders can obtain notice of any Addenda to the Contract Documents, Contract Documents must be obtained in person or by mail from the Montana Department of Environmental Quality (“DEQ”), Remediation Division (406) 841-5000 after September 20, 2013. Contract documents will be obtained for a non-refundable deposit of $75.00 in advance, in cash or check payable to “Department of Environmental Quality.” Credit Cards are not be accepted.

A mandatory pre-bid conference and walk-through will be held for prospective bidders on October 2, 2014.  The walk-through will meet at 12:00 noon at the project site.  After a description of the project, bidders will walk the project areas for additional project discussion and bidders’ questions.  Prospective bidders should dress and plan accordingly.  Both the pre-bid conference and the walk-through are mandatory: bidding contractors are required to attend.  Failure to attend the pre-bid conference and walk through is a basis for Owner to reject the bid under Article 5 of the Instruction to Bidders.  
Bids must be submitted in accordance with Instructions to Bidders and with the laws of the State of Montana.
All workers employed in performance of the project work must be paid prevailing wages at rates required by Federal regulation and the laws of the State of Montana.  
Bidders must ensure that employees and applicants for employment are not discriminated against because of their race, color, religion, sex, or national origin.  
Subject to the provisions of the Americans With Disabilities Act of 1990, no qualified individual with a disability will, by reason of such disability, be excluded from participation in or be denied the benefits of the services, programs or services of a public entity or be subject to discrimination by any such entity.  Persons with disabilities seeking accommodation may contact DEQ to make their request.
