Reference is hereby made to that certain trust indenture/deed of trust ("Deed of Trust") dated 02/07/06, recorded as Instrument No. 134283, mortgage records of CUSTER County, Montana in which Christopher E. Mosdal and Rebecca S. Mosdal was Grantor, New Century Mortgage Corporation was Beneficiary and Security Abstract was Trustee. First American Title Insurance Company has succeeded Security Abstract as Successor Trustee. The Deed of Trust encumbers real property ("Property") located in CUSTER County, Montana, more particularly described as follows: Lots 7, 8, 9 and 10 in Block 1 of Darling's Addition to the City of Miles City, Custer County, Montana, according to the Official Plat and Survey thereof now on file and of record in the Office of the County Clerk and Recorder in and for Custer County, Montana. By written instrument recorded as Instrument No. 162494, beneficial interest in the Deed of Trust was assigned to Deutsche Bank National Trust Company, as Trustee for Morgan Stanley ABS Capital I Inc. Trust 2006-HE4, Mortgage Pass-Through Certificates, Series 2006-HE4. Beneficiary has declared the Grantor in default of the terms of the Deed of Trust and the promissory note ("Note") secured by the Deed of Trust because of Grantor's failure timely to pay all monthly installments of principal, interest and, if applicable, escrow reserves for taxes and/or insurance as required by the Note and Deed of Trust. According to the Beneficiary, the obligation evidenced by the Note ("Loan") is now due for the 02/01/14 installment payment and all monthly installment payments due thereafter.
