THE FOLLOWING LEGALLY DESCRIBED TRUST PROPERTY TO BE SOLD FOR CASH AT TRUSTEE'S SALE.  Notice is hereby given that the undersigned Successor Trustee will, on May 27, 2016 at the hour of 11:00 AM, sell at public auction to the highest bidder for cash, the interest in the following described real property which the Grantor has or had power to convey at the time of execution by him of the said Deed of Trust, together with any interest which the Grantor or his successors in interest acquired after the execution of said Deed of Trust, to satisfy the obligations thereby secured and the costs and expenses of sale, including reasonable charges by the Successor Trustee, at the following place:

John A. “Joe” Solseng, a member of the Montana state bar, of Robinson Tait, P.S. is the duly appointed Trustee under and pursuant to the Deed of Trust in which John S. Salazar, and Kathleen Salazar, as Grantors, conveyed said real property to FIDELITY NATIONAL TITLE INSURANCE CO., AN ARIZONA CORPORATION as Trustee, to secure an obligation owed to MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INC AS NOMINEE FOR COUNTRYWIDE HOME LOANS, INC., ITS SUCCESSORS AND ASSIGNS, Beneficiary of the security instrument, said Deed of Trust which is dated July 24, 2003 and was recorded on July 29, 2003 as Instrument No. 125343, of official records in the Office of the Recorder of Custer County, Montana.
The Deed of Trust encumbers real property (“Property”) located at HC 46 BOX 0017, MILES CITY, MT 59301 and being more fully described as follows:
TRACT NO. 1 LOCATED IN UNIT 76 OF THE KINSEY PLATS PROJECT IN CUSTER COUNTY, MONTANA, ACCORDING TO THE PLAT AND SURVEY OF SAID TRACT 1, FILED FOR REORD AS DOCUMENT NO. 36237 IN ENVELOPE NO. 57 OF THE PLAT CABINET IN THE OFFICE OF THE COUNTY CLERK AND RECORDER IN AND FOR CUSTER COUNTY, MONTANA.
The beneficial interest under said Deed of Trust and the obligations secured thereby are presently held by The Bank of New York Mellon Trust Company, National Association fka The Bank of New York Trust Company, N.A. as successor to JPMorgan Chase Bank, N.A., as Trustee for Residential Asset Mortgage Products, Inc., Mortgage Asset-Backed Pass-Through Certificates Series 2006-RP2.
The Beneficiary has declared the Grantor in default of the terms of the Deed of Trust and the Promissory Note (“Note”) secured by said Deed of Trust due to Grantor's failure to timely pay all monthly installments of principal, interest and if applicable, escrow reserves for taxes and/or insurance as required by the Note and Deed of Trust.  The default for which foreclosure is made is grantors’ failure to pay when due the following sums: monthly payments beginning February 1, 2015 totaling $1,769.19; plus interest due of $2,971.29; plus escrow payment of $2,148.60; less suspense balance of $358.41; together with title expense, costs, trustee’s fees and attorney’s fees incurred herein by reason of said default; any further sums advanced by the beneficiary for the protection of the above described real property and its interest therein; and prepayment penalties/premiums, if  applicable.
By reason of said default, the beneficiary has declared all sums owing on the obligation secured by said trust deed immediately due and payable, said sums being the following, to wit: $54,826.46 with interest thereon at the rate of 5.50000 percent per annum beginning January 1, 2015; plus uncollected late charges of $272.70; plus escrow advances of $1,982.36; plus property inspection fees totaling $198.50; plus title search of $305.75; plus other foreclosure fees and costs of $888.00; plus other costs of $33.12; less suspense credit of $358.41; together with title expense, costs, trustee’s fees and attorney’s fees incurred herein by reason of said default; any further sums advanced by the beneficiary for the protection of the above described property and its interest therein; and prepayment penalties/premiums, if applicable.
Due to the defaults stated above, the Beneficiary has elected and has directed the Trustee to sell the above-described property to satisfy the obligation.
Notice is further given that any person named has the right, at any time prior to the date last set for the sale, to have this foreclosure proceeding dismissed and the Deed of Trust reinstated by making payment to the Beneficiary of the entire amount then due (other than such portion of the principal as would not then be due had no default occurred) and by curing any other default complained of herein that is capable of being cured by tendering the performance required under the obligation or to cure the default, by paying all costs and expenses actually incurred in enforcing the obligation and Deed of Trust, together with Successor Trustee’s and attorney’s fees.
If the Trustee is unable to convey title for any reason, the successful bidder's sole and exclusive remedy shall be the return of monies paid to the Successor Trustee and the successful bidder shall have no further recourse.
